How Avenyst handles personal data collected through this website.

1. Who we are
This website (avenyst.com) is operated by AVENYST CONSULTING S.R.L., a company incorporated under the laws of Argentina, with its registered seat in Rosario, Province of Santa Fe, Argentina, and trading as “Avenyst” (“Avenyst”, “we”, “us”). You can reach us at info@avenyst.com.
Avenyst is a business-to-business data and AI consultancy. We provide SAP cloud migration, Snowflake and Databricks services, Microsoft Azure and Google Cloud implementations, enterprise data strategy, and related professional services to enterprise organizations. Our primary operations are in Argentina, and we maintain a commercial presence in the United States through AVENTIS IT LLC, an affiliated company domiciled in Dover, Delaware, United States.
For the personal data described in this policy, AVENYST CONSULTING S.R.L. decides why and how that data is processed. It therefore acts as the responsable del tratamiento under Argentina's Ley 25.326 de Protección de los Datos Personales and its implementing regulations, and as the data controller under any applicable GDPR-style regime.
2. Scope of this policy
This policy covers personal data we collect through this marketing website only. It does not cover:
- Personal data we process on behalf of a client under a signed consulting agreement. In those engagements Avenyst generally acts as a processor (encargado) and the applicable terms are set out in that agreement and any accompanying data processing addendum.
- Third-party websites or platforms you reach from links on this site, including LinkedIn. Those services have their own privacy policies.
- Recruitment or employment data, which is handled separately.
This website does not offer user accounts, logins, or online purchases, and it is not directed at consumers.
3. Personal data we collect
Information you submit to us. Our contact page hosts a web form provided by HubSpot. When you complete and submit that form, the data you enter is transmitted to and stored in HubSpot's CRM platform on our behalf. This typically includes your name, business email address, company name, job title, and any message or project details you choose to provide. If you email us directly at info@avenyst.com, we receive the contents of your message and your email address.
Usage and device information. If you accept analytics cookies through our cookie banner, this site loads Google Analytics 4. It collects information such as pages viewed, referring page, approximate location derived from IP address, browser and device type, language, and interactions with links and calls to action. We have enabled Google's IP anonymization setting for this property, so the IP address is truncated by Google before it is used for geolocation.
Technical logs. Our hosting provider records standard server and request logs, which may include IP addresses, timestamps, and requested URLs, for security and operational purposes.
We do not knowingly collect special categories of personal data (such as health, biometric, or financial account data) through this website, and we ask that you do not submit such data through the contact form.
4. Why we use it, and on what legal basis
- To respond to your enquiry and pursue a business relationship. Where a GDPR-style regime applies, we rely on the legitimate interest of responding to a business enquiry, or on steps taken at your request prior to entering a contract.
- To send business communications about our services, where you have asked to receive them or where doing so is permitted for business contacts. Every marketing email includes an unsubscribe mechanism.
- To measure and improve the website, using analytics. Where consent is required for analytics cookies, we rely on your consent; otherwise we rely on our legitimate interest in understanding how the site is used.
- To keep the site secure and operational, and to comply with legal obligations. Here we rely on our legitimate interests and on legal obligation, as applicable.
We do not sell personal data, and we do not share it for cross-context behavioral advertising as those terms are defined under California law.
6. Service providers and international transfers
We use a small number of third-party providers who process personal data on our instructions:
- HubSpot, Inc. — CRM and marketing platform. Hosts and stores contact form submissions.
- Google LLC — Google Analytics 4. Provides website measurement.
- Our website hosting provider — serves this site and maintains operational logs.
These providers are located primarily in the United States, while Avenyst operates from Argentina and maintains a commercial presence in the United States. Consequently, personal data collected through this site may be transferred to, stored in, and accessed from countries other than the one in which you are located, including countries whose data protection laws differ from those of your own.
Where such a transfer requires a specific legal mechanism, we rely on Standard Contractual Clauses (SCCs) and on the exceptions provided for by Ley 25.326 and its implementing regulations.
We may also disclose personal data where we are legally required to do so, or where necessary to establish, exercise, or defend legal claims. We do not sell or transfer your personal data to third parties for advertising purposes.
7. How long we keep it
We keep personal data only for as long as it is needed for the purpose it was collected for, and then delete it or anonymize it.
- Contact form and email enquiries that do not lead to an engagement: 2 years.
- Contact records for active or prospective client relationships: 3 years from the last contact.
- Analytics data: retained according to the retention setting configured in our Google Analytics property, 14 months.
- Server logs: 12 months.
We may keep data for longer where a legal or regulatory obligation requires it.
8. Your rights
The rights available to you depend on where you are located and which law applies.
If you are in Argentina (Ley 25.326)
You may request access to your personal data, as well as its rectification, updating, and deletion, under Ley 25.326 and its implementing regulations. Data subjects are entitled to request access free of charge, within the periods and intervals the regulations set out. If you believe we have not handled your request properly, you may file a complaint with the Agencia de Acceso a la Información Pública (AAIP), the Argentine supervisory authority.
If a GDPR-style regime applies to you
You may have the right to request access to your personal data; to have inaccurate data corrected; to have data erased; to restrict or object to processing, including objecting to processing based on legitimate interests and to direct marketing; to data portability; and to withdraw consent at any time where processing is based on consent, without affecting processing carried out before withdrawal. You may also lodge a complaint with your local supervisory authority.
If you are a California resident (CCPA/CPRA)
You may have the right to know what personal information we have collected about you and the categories of sources, purposes, and recipients; to request deletion; to request correction; to limit the use of sensitive personal information; and to opt out of the sale or sharing of personal information. As stated above, we do not sell or share personal information as those terms are defined by California law. We will not discriminate against you for exercising these rights. An authorized agent may submit a request on your behalf, subject to verification.
How to request deletion of your data
Wherever you are located, you may ask us to delete the personal data we have collected about you through this site. To do so, email info@avenyst.com with the subject line “Personal data deletion”, stating the email address you contacted us from so we can locate your record. We may need to verify your identity before acting on the request. We will respond within the period required by applicable law and, unless a legal obligation requires us to retain certain information, we will delete your data from our CRM and email systems.

9. Security
We apply administrative and technical measures intended to protect personal data against unauthorized access, loss, or misuse, including transport encryption on this website (HTTPS), HTTP security headers, role-restricted access to our CRM, and multi-factor authentication on the platforms we use. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
This section describes our practices. It is not a claim to hold any certification, attestation, or audit report.
10. Children
This website is intended for business audiences. We do not direct it at children and we do not knowingly collect personal data from them. If you believe a child has provided us with personal data, contact us and we will delete it.
11. Changes to this policy
We may update this policy to reflect changes in our practices or in applicable law. The effective date at the top of this page indicates when the current version took effect. Material changes will be communicated by posting the updated policy on this page.
